nBuddy’S PRIVACY POLICY

This Privacy Policy should be read in conjunction with HeartVoice’s Terms & Conditions (above).

The HeartVoicePrivacy Policy (“Privacy Policy”) informs you regarding the collection, use and disclosure of Personal Information and Personal Health Information (see below for full details) we receive from users of nBuddy – i.e. You.

By accessing or using nBuddy Application or Services, you agree to the collection and use of information in accordance with this policy. Please read these Terms & Privacy carefully before installing our Application or using our services. If you do not understand the Terms & Conditions and or Privacy Policy, or do not accept any part of them, then you should not use our services.

INFORMATION COLLECTION AND USAGE

Personally identifiable information

While using the nBuddy Application, we will ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name, contact information, email etc. (“Personal Information”). We use your Personal Information for providing and improving nBuddy Application, our websites and our service to you through our Application.

By submitting your personal data to nBuddy or HeartVoice, you consent to us collecting, using, disclosing and processing your personal data; including: – communicating with you, responding to your enquiries and providing information of services and/or promotions to you. To discontinue the processing and use of your personal data, please write in to support@ourheartvoice.com.

Personal health information collection

As part of our Application and our service to you we will be collecting general health information (“Personal Health Information”) that you provide through the Application. We use your Personal Health Information for providing and improving nBuddy, our websites and our service to you through our Application.

We will be storing this information, making and generating reports and trends for feedback to you and your Peer Chat (see below). By submitting your personal data to nBuddy or HeartVoice, you consent to us collecting, using, disclosing and processing your Personal Health Information as well as sharing it with your Peer Chat.

PEER CHAT ACCESS TO YOUR PERSONAL INFORMATION AND PERSONAL HEALTH INFORMATION

The Peer Chat function allows you to invite friends and family to participate in your use of the nBuddy Application. You consent to both Personal Information and Personal Health Information released into the Peer Chat. Such information may be intentionally or inadvertently released by users in your Peer Chat. HeartVoice is not responsible for the dissemination of such information by Users you invite into your Peer Chat and you agree to hold HeartVoice and nBuddy harmless should such Users violate your privacy.

Upon the termination of a User (“Previous Peer Chat Participant”) from your Peer Chat, HeartVoice will delete the chat and remove data and information still stored on the Previous Peer Chat Participant’s Peer Chat. HeartVoice cannot absolutely guarantee the full removal of all your data from that Previous Peer Chat Participant’s Peer Chat.

YOUR TECHNICAL INFORMATION THAT WE COLLECT

When you use our services, we automatically collect information about the device you use to access our services and your usage of our Application. The information we collect may include (where available) the type and model of the device you use, the device’s unique device identifier, operating system, language options and mobile network information to allow you to use our services. We use this information to administer our services and for our internal operations including troubleshooting, data analysis, testing, research, statistical and survey purposes, to improve our services.

Please note that our services require access to your device’s storage application in order to store application data and media, such as photos, but we do not take any information, videos, photos or other content from your device’s storage application unless you have uploaded this into the Chat. To fully experience our Application and Services, please note that you should enable us to access to permissions in your phone such as record, camera, microphone, location and etc. You can disable such access permission in settings of your mobile device but you will not experience the Application at its highest functionality.

SECURITY

The security of your Personal Information and Personal Health Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information or Personal Health Information, we cannot guarantee its absolute security.

RELEASE OF INFORMATION TO THIRD PARTY HEALTHCARE PROVIDERS

If you are signed up as a referral by a Third Party Healthcare Provider, you consent to us giving both your Personal Information as well as your Personal Health Information to the Third Party Healthcare Provider.

USE OF THIRD PARTY SERVICES

Our Application and Services may include links to mobile features and services (including but not limited to, social applications like Facebook, Instagram and YouTube, or Apple’s HealthKit) that are provided by a third party. We do not control such third party sites or services and are not responsible for the content or functionality of such sites or services. Our inclusion of links does not imply any endorsement or association with their operators. The terms applicable to the use of such third party services will apply and we will not be responsible for anything that is done by you or the third party service provider in connection with your use of their service. Please note that we will not keep or release your Personal Information or Personal Health Information on the third party apps/websites except for specific release of information to Third Party Healthcare Providers should you be referred from them.

ADVERTISING

We may deliver advertising to you in conjunction with your use of our services.

DELETION OF INFORMATION

When you terminate the Agreement, or delete the Application, HeartVoice still retains both your Personal Information and Personal Health Information on its Servers.

To perform a full delete please email us at support@ourheartvoice.com for us to delete all Personal Information and Personal Health Information pertaining to yourself. As per the Terms of Service (above), you consent to HeartVoice keeping all User Content that removes all identifiable references to yourself.

DETAILS OF CORRESPONDENCE

If you contact us by email, we will keep a record of that correspondence in our system.

EMAILING YOU WITH NEWSLETTERS, INFORMATION OR REMINDERS

We will use your Personal Information to contact you with periodic newsletters, tips, and/or reminders via email. You may opt out by following the unsubscribe instructions provided in any email we send.

COOKIES

When you use our services, certain information may be stored locally on your mobile device using ‘cookies’ or similar technologies such as objects stored in our service’s local storage on the device that you are using. A cookie is a small text file or data file used to store limited information about the user of the device and is stored on your device. It helps us to identify how our users use our services and so that we can continuously evolve and improve it. We use information collected from cookies to improve users’ experience and the overall quality of our services.

CHANGES TO TERMS OF SERVICE AND PRIVACY POLICY

This Terms of Service and Privacy Policy is effective as of 09 November 2016 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on our website or on the Application. We reserve the right to update or change our Terms of Service and Privacy Policy at any time and you should check our Terms of Service and Privacy Policy periodically.

If we make any material changes to this Terms of Service and Privacy Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on our website.

Your continued use of the nBuddy Application and Services after we post any modifications to the Terms of Service and Privacy Policy will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Terms of Service and Privacy Policy.
